General terms and conditions for Apartment 41a
1 Subject matter of the contract
The subject of the contract is the furnished apartment on the top floor of the house at Am Fasanenhof 41a, Kassel. The rental is limited to temporary use for residential purposes and to the number of people specified in the contract. Changes to the number of people require the consent of the landlord. Subletting or re-letting is not permitted. For the price calculation and the scope of the contractually owed services, only the service description of the apartment on the website www.apartment-41a.smoobu.net is decisive. Side agreements are only binding if they are confirmed in writing.
2 Conclusion of contract
The contract can be concluded through a booking confirmation from the landlord, the return of a signed rental contract or an indirect declaration of acceptance by the tenant. An indirect declaration of acceptance exists in particular in the payment of the rental price or part thereof or in another declaration by the tenant (by telephone or in writing).
3 Rental price
The rental price includes the statutory VAT on the remaining rental price at the time the contract is concluded. The costs for heating, energy supply and waste disposal are also always included. The due dates of the down payment and the remaining rental amount are specified in the contract. If this day falls on a weekend or a public holiday, the next working day is the due date.
4 Pets
Pets are generally not allowed in the apartment. Exceptions require the express consent of the landlord.
5 Internet
Internet access via WLAN and LAN is available in the apartment. Each user is liable for the data and content that is downloaded or uploaded by him via the landlord's network. The user undertakes not to distribute any activities or content relevant to criminal law via the house's internet connection. Each user is responsible for backing up their data, software and hardware.
6 Resignation by the guest
Cancellations of this contract are free of charge up to 2 weeks before the start of the rental period. The following compensation rates are to be paid within the 2 weeks before the start of the rental period: 8.-13. day before the start of the journey: 50% of the overnight price 1.-7th day before the start of the journey: 80% of the overnight price. If a new letting succeeds, the cancellation fees do not apply.
7 Landlords' rights
The landlords are entitled to withdraw if the due payments are not made even after a grace period. In addition, the landlords are entitled to extraordinarily withdraw from the contract for an objectively justified reason, e.g. if force majeure or other circumstances for which the landlord is not responsible make the fulfillment of the contract impossible or the apartment with misleading or false information on essential facts, e.g. in the person of the tenant or the purpose. In these cases, the landlord will reimburse rent that has already been paid. The landlords or their agents are entitled to enter the holiday home for maintenance, repair and upkeep purposes during the day between 10:00 and 18:00, preferably by appointment.
8 Liability of the lessee
The tenant is liable for damage caused by him and has to inform the landlord of this. He is responsible for the rental period for the apartment and undertakes to keep it in a tidy and clean condition. He bears his own risk in the event of improper handling of all items made available by the landlord. The landlord is not liable for damage to the property of the guest, for personal injury, etc. The landlord waives the replacement of minor damage worth less than EUR 15 if you are informed of the damage.
9 Obligation to supervise children, disclaimer of liability
In the garden of the landlord there is a garden pond that is not fenced. We expressly point out that the tenants have a duty to supervise their children and are responsible for their safety. Liability on the part of the landlord is excluded.
10 Smoking
Smoking is generally not permitted in the apartment. The tenant is liable for the possibly considerable additional cleaning effort and possible rescue service costs that arise from a smoke alarm triggered by him.
11 Place of jurisdiction
Kassel is agreed as the place of jurisdiction.
